Getting your housemate evicted?

so here's the deal. i live in a house with 2 other girls, we each have a room ( 2 of us upstairs and one downstairs) the thing is the girl that lives downstairs hasn't been paying rent at all.. it's gotten so bad that we've gotten a third warning and a eviction notice. not only has she not been paying rent on time she still owes me and my other housemate money for the utilities. today after we got the eviction notice we taped it to her door (she sleeps during the day and wakes up at ungodly hours to slam cabinet doors and "cook" oh and did i mention she hasn't left her room in 7 days other than to slam more cabinet doors) then an hour later when she saw the notice she storms up to our room screaming at us saying we never told her rent is due (even though we reminded her PLENTY of times) and that we never told her how much utilities were (even though we put a copy of the bill along with how much we all owe on the fridge and on post-its on her door) after we told her that in the contract we had amongst ourselves it stated that utilities and rent is to be paid every 1st of the month. she then proceeded to storm downstairs and write us a check (wasn't even the right amount) and threw it at our faces as if we were beggars and slammed her door and started talking LOUDLY on the phone and calling us foul names.



we've basically ruled out the possibility that she's depressed since she's always laughing loudly and screaming (out of joy?) on the phone, it's gotten so bad the people who live downstairs started complain already and it's only been 2 months since we moved in. on top of that i live in a loft and i hear what goes on in the kitchen, every night between the hours of 2 am-6 am she's the most active (since she sleeps all day and doesn't go to class) that's when she BLASTS her tv on full blast while she talks on the phone (usually screaming out of excitement), and stomps and slams doors/cabinets and cooks eggs and toasts 10 pieces of bread (come on who in the world eats 10 pieces of bread at ONCE?) all while my other housemate and i are trying to sleep since we have 8am classes. OH JOY. even thorough our earplugs we can hear her.



i know, it was stupid of us to sign a lease with her but she wasn't bad in the beginning. she only got bad after she moved in here and she's adopted this "i'm better than you" attitude and thinks that "we owe her for staying" since this other girl that was suppose to live here as well flaked and made us all pay her share of the rent.



SO.. after that LONG explanation.. my question is. how do i get her evicted if that's even possible? there has to be SOMETHING we can do besides the "sitting down with her and her parents and talking to her" because we tried that already.. didn't work. in fact it lead to today's "yelling at the upstairs housemate" episode :(



oh and by the way we all pay rent to the manager's office on separate checks.

What you can do is put in a notice to the landlord telling him the reason's why you haven't kept up the date with the rent and explaining your situation.......After the notice is filed put a notice in to her saying that she has only such and such amount of days to stay there and she would have to find alternative accommodation...You can ring up the Board of rental properties and make an complaint to them and they can tell you what further action you can take with her...

Tell your neighbours when she starts screaming or whatever call for the police and they can escort off the property...When that happens you can get a police report off them and use that as your defence when or if they ever want to convict you and your other room mate...She is breaching the rental agree meant by you and your room mate. This is what they call "living in a happy peaceful environment"

first of all, you and your friend who pays on time go talk to the landlord and explain the situation. tell him/her that you both want to continue living there but want to get the girl replaced, and what you two can do. look for a replacement roommate while you are at it.
